1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of car rental services provided by Silvana ("we," "us," or "our"). By renting a vehicle from Silvana, submitting a reservation, or using our website, you agree to be bound by these Terms.

Please read these Terms carefully before making a reservation. If you do not agree with any part of these Terms, you should not use our services.

These Terms constitute a legal agreement between you ("Customer," "you," or "your") and Silvana.

2. Definitions

• "Rental Agreement" refers to the contract formed when you accept these Terms and complete a vehicle reservation.
• "Vehicle" means any car, SUV, or other automobile provided by Silvana for rental purposes.
• "Rental Period" is the duration from vehicle pickup to return, as specified in your reservation.
• "Services" includes vehicle rental, GPS navigation, insurance, roadside assistance, and related offerings.
• "Authorized Driver" is any person approved by Silvana to operate the rental vehicle.

3. Rental Eligibility

Age Requirements

• Primary driver must be at least 21 years of age
• Drivers under 25 may be subject to additional requirements or fees
• Some vehicle categories may require drivers to be 25 or older

License Requirements

• Valid driver's license held for at least one year
• International visitors must present an International Driving Permit alongside their home country license
• All licenses must be in Roman alphabet or accompanied by certified translation

Additional Requirements

• Valid passport or national ID for identification
• Major credit card in the driver's name for security deposit
• Contact information (phone and email) for rental coordination

4. Reservations and Payment

Booking Process

Reservations can be made through our website, email, or phone. All reservations are subject to vehicle availability and confirmation by Silvana.

Payment Terms

• Rental fees are charged at the beginning of the rental period
• Security deposit held on credit card throughout rental duration
• Payment accepted in New Taiwan Dollars (NT$) via major credit cards
• Additional charges (fuel, tolls, damages) settled at vehicle return

Cancellations and Modifications

• Cancellations made 72+ hours before pickup: Full refund
• Cancellations made 24-72 hours before pickup: 50% fee applies
• Cancellations made less than 24 hours before pickup: Full rental fee charged
• Modification requests subject to availability and may incur fees

5. Vehicle Use and Restrictions

Permitted Use

You may use the vehicle for personal transportation within Taiwan during the rental period. The vehicle must be:

• Operated only by authorized drivers listed on the rental agreement
• Driven on paved roads suitable for the vehicle type
• Used in compliance with all Taiwan traffic laws and regulations
• Returned in the same condition as received, normal wear excepted

Prohibited Use

You agree NOT to:

• Allow unauthorized persons to drive the vehicle
• Use the vehicle for commercial purposes (taxi service, delivery, ride-sharing) without written permission
• Transport passengers or cargo for hire
• Drive the vehicle while under the influence of alcohol or drugs
• Use the vehicle in any race, competition, or speed test
• Drive on unpaved roads, beaches, or unsuitable terrain
• Transport illegal materials or engage in unlawful activities
• Exceed posted speed limits or drive recklessly
• Smoke in the vehicle
• Transport pets without prior approval

6. Insurance and Liability

Included Coverage

All rentals include:

• Third-party liability insurance as required by Taiwan law
• Collision damage waiver (with deductible as specified in agreement)
• Theft protection
• 24-hour roadside assistance

Customer Responsibility

You are responsible for:

• Any deductible amount specified in the rental agreement
• Damages resulting from prohibited use or violations of these Terms
• Damage to vehicle interior, including cleaning fees for excessive soiling
• Loss of keys, GPS devices, or other rental equipment
• Parking fines, traffic violations, and toll charges incurred during rental

Accident Procedures

In case of accident or damage:

1. Contact local authorities and file a police report
2. Notify Silvana immediately at +886 3 5284 7196
3. Document the incident with photos and witness information
4. Do not admit fault or make commitments on Silvana's behalf
5. Complete accident report form and submit within 24 hours

7. Fuel, Maintenance, and Roadside Assistance

Fuel Policy

• Vehicle provided with full tank of fuel
• Customer must return vehicle with full tank or pay refueling charge
• Use only fuel type specified on fuel cap and rental agreement

Maintenance During Rental

• Silvana handles all scheduled maintenance
• Customer must monitor fluid levels and tire pressure
• Report any mechanical issues immediately
• Do not attempt repairs without Silvana authorization

Roadside Assistance

24-hour roadside assistance included for:

• Mechanical breakdowns
• Flat tires and jump starts
• Lockout service
• Towing if needed

8. Vehicle Return

• Return vehicle at agreed time and location
• Late returns subject to additional daily charges
• Vehicle must be returned clean; excessive cleaning fees may apply
• Personal belongings are customer's responsibility; Silvana not liable for lost items
• Return inspection conducted to assess condition and mileage
• Security deposit refunded within 7-14 business days after return, less any deductions for damage or violations

9. Disclaimers

Service Availability

Vehicles and services are provided on an "as available" basis. We cannot guarantee specific vehicle models, though we will provide similar vehicles in the same category when possible.

No Guarantee of Results

While we provide route suggestions and travel assistance, we do not guarantee specific outcomes, travel times, or experiences. Road conditions, traffic, and other factors are beyond our control.

GPS and Navigation

GPS devices are provided as a courtesy. Accuracy and functionality may vary. Customers are responsible for verifying routes and following traffic laws.

10. Limitation of Liability

To the maximum extent permitted by Taiwan law:

• Silvana's total liability shall not exceed the total rental fees paid
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for delays, cancellations due to force majeure events (natural disasters, government actions, etc.)
• Personal property left in vehicle is customer's responsibility

This limitation does not apply to liability for personal injury caused by our negligence or statutory obligations that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold Silvana harmless from any claims, damages, liabilities, or expenses arising from your use of the rental vehicle, including violations of these Terms, traffic laws, or damages caused by unauthorized use.

12. Termination

Silvana's Right to Terminate

We may terminate the rental agreement immediately and repossess the vehicle if:

• You violate these Terms
• You provide false information during rental process
• The vehicle is used for illegal purposes
• Payment obligations are not met
• We reasonably believe the vehicle is at risk

Customer Termination

You may return the vehicle early. However, no refund will be provided for unused rental days unless otherwise agreed in writing.

13. Dispute Resolution

Informal Resolution

Before pursuing formal action, parties agree to attempt resolution through good-faith negotiation. Contact us at [email protected] to initiate the process.

Governing Law

These Terms are governed by the laws of Taiwan. Any disputes will be subject to the jurisdiction of Taiwan courts.

Arbitration

If informal resolution fails, disputes may be submitted to arbitration in Hsinchu, Taiwan, in accordance with Taiwan arbitration procedures, unless litigation is more appropriate under applicable law.

14. General Provisions

Entire Agreement

These Terms, together with the rental agreement and any additional policies, constitute the entire agreement between you and Silvana.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

Waiver

Failure to enforce any provision does not constitute waiver of that or any other provision.

Assignment

You may not assign or transfer your rights under these Terms. Silvana may assign its rights and obligations with notice to you.

Notices to Silvana should be sent to [email protected]. We will send notices to the email address provided in your reservation.

15. Changes to Terms

Silvana reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. We will notify active customers of material changes via email.

Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.
